I have completed on August 9, 2017, initial drafting of the chapter on arbitrability and arbitral jurisdiction that I was asked to contribute to the forthcoming Practicing Law Institute (PLI) treatise on US domestic commercial arbitration. This chapter covers a wide range of subjects and includes treatment of US Supreme Court jurisprudence on allocation of power between courts and arbitrators, FAA pre-emption of state law, and scope of judicial review of arbitrators’ arbitrability decisions.

On August 3, 2017, I had the privilege to participate as a speaker in a panel discussion on “Damages in International Arbitration: Expectations and Awards,” presented by the PriceWaterhouseCoopers Forensic Services Group in collaboration with the Columbia Center on Sustainable Investment’s Executive Training on Investment Treaties and Arbitration for Government Officials.

I spoke on “Promoting Efficiency in Arbitration” as a panelist at the Toronto Commercial Arbitration Society’s Annual Conference on May 18, 2017. My remarks devoted some attention to the use of summary disposition methods in international arbitration, a subject receiving much current attention in view of the recent adoption of new rules by the Stockholm and Singapore arbitration centres.

In conjunction with my oral presentation on Emergency Arbitration made at the 11th Annual Fordham Conference on International Arbitration & Mediation on October 13, 2016, my conference paper “A Glance Into History for the Emergency Arbitrator” is in the final stages of editing for publication by the Fordham International Law Journal in its annual compendium of the Fordham Conference Papers.

I have served since January 2016 as a party-appointed co-arbitrator under the AAA International Arbitration Rules (ICDR) in a dispute in the aviation section. Merits hearings were held in New York in December 2016 and the final award was issued in March 2017.

I currently serve as the presiding arbitrator in a dispute in the international pharmaceutical sector under the ICC Arbitration Rules. Merits hearings were held in Miami in March 2017.

I currently serve as a co-arbitrator in a dispute in the transportation sector under the AAA Large and Complex Case Rules. Merits hearings are scheduled to take place in New York in May 2017.

Mr. Goldstein has been selected for the fourth consecutive year for listing in Who’s Who Legal: Arbitration, published by London-based Law Business Research LTD., the publisher of Global Arbitration Review. According to its website, Who’s Who Legal “since 1996 has identified the foremost legal practitioners in multiple areas of business law. … We pride ourselves on the integrity and authority of our findings.”

Mr. Goldstein has been selected as a leading practitioner in commercial arbitration for inclusion in the Euromoney Commercial Arbitration Expert Guide 2016 (13th Edition), publication date September 8, 2016. Euromoney’s Legal Media Group selects practitioners for inclusion in its Expert Guides based upon a four-stage process — general nomination, independent research, candidate selection, and shortlisting. Mr. Goldstein was first included in the Euromoney Expert Guide for Commercial Arbitration in its first edition in 2002.

On August 15, 2016, The Best Lawyers in America® announced that Mr. Goldstein has been selected by his peers for inclusion in The Best Lawyers in America® 2017 in the practice area of International Arbitration – Commercial. Best Lawyers® lists are compiled based on exhaustive peer review evaluation. Corporate Counsel magazine has called Best Lawyers® “the most respected referral list of attorneys in practice”.
